First, some good news: Dragon Quest Productions hasn’t filed any new lawsuits since mid-November (that I am aware of).
I’ve been watching a couple of their cases in Northern District of Illinois. I’ve previously written about each of the cases mentioned below. There are no major developments in, however each case appears to be moving forward in a manner that is favorable to the Plaintiff. In other words, the “settlement machine” is working in this district.
Dragon Quest Productions, LLC v. Does 1-100, Case No. 1:12-cv-07812
Some defendants are settling and being dismissed with prejudice.
Dragon Quest Productions, LLC v. Does 1-80, Case No. 1:12-cv-07815
The judge denied the anonymous Motion To Quash that was entered on behalf of all defendants in a minute entry:
Motion of Does No. 1-80 to quash 14 is denied without prejudice with leave to refile if identity of movant is indicated in the motion.
The motion for discovery, entered by Plaintiff in late October, still has not been ruled on. Until the judge rules favorably on that for the Plaintiff, John Doe identities are safe and the settlement machine cannot be turned on.
Dragon Quest Productions LLC v. Does 1-30, Case No. 1:12-cv-07808
Some defendants are being dismissed – some with prejudice, and some without.
Dragon Question also has one case in D. NJ:
Dragon Quest Productions LLC v. John Does 1-100, Case No. 1:12-cv-06611
This one is litigated by Stamatios Stamoulis. In that case, Magistrate Judge Donio, citing Next Phase Distribution, Inc. v. John Does 1 – 27, (S.D.N.Y., July 31, 2012), is requiring the Plaintiff to show cause as to why all John Does except #1 should not be severed and dismissed. The Plaintiff’s response hasn’t been filed yet. It is due 3/18/13 – just three days from today.
Let’s turn to the E.D. Tenn. Dragon Quest has one suit there:
Dragon Quest Productions LLC v. Does 1-100, Case No. 3:12-cv-00597. Early discovery was granted and Motions to Quash are filling the docket. The Plaintiff is opposing the MTQs. Some defendants have been dismissed from the action.
